Shooter was a firearms instructor. How do you feel about this?
Mandeville, LA: The surveillance video shows perp (Breland) arguing with the clerk and jabbing his index finger in the air at him. Mandeville police said at the time that he was berating the clerk and using racial slurs. The clerk told him to leave, but Breland kept returning to the store, at one point throwing packages of chips at the clerk. The armed customer followed Breland outside to get the license plate number from Breland’s vehicle, police said, prompting Breland to attack him.The video shows Breland backing the other man up inside the store and finally cornering him. Then Breland can be seen crumpling and sitting on the floor, rubbing his face. The clerk called police when the altercation began, but Breland had been shot by the time they arrived. Mandeville police, who interviewed witnesses and viewed the footage, said the shooter drew his weapon and ordered Breland back, but to no avail. He shot him once in the torso, and when Breland continued to come after him, fired two more rounds. Montgomery said Breland’s death was a tragedy but was legally justified. |

I haven't watched the video, I'd rather not but this is another reason why civilians shouldn't be walking around armed imo

...yeah, this really...it's hard to say because of there being no sound but it seems to me, that he could have restrained him without killing him, had he have had two free hands...but he was trying to attempt it one-handed because he was holding his gun in the other...

Its the USA the guy warned him repeatedly he had a weapon and the big bully refused to desist, so the guy shot and killed him. End of really

..he as pushing the gut back with one hand because his other hand was holding the gun and at no point does it look on the vid as though anyone's life was in danger...all both of the were doing was just pushing each other so no need for any loss of life at all...

The perp was about Twice the size, he had been warned repeatedly about the weapon. In the USA guns are for protection and the perp was threatening harm

..(from the vid..)..there was no threat to anyone's life whatsoever, not even any punches being thrown../just a lot of pushing so no protection was needed by the taking of a life..whether it be USA or wherever...he may have been larger in build but looks quite unsteady on his feet and unable to have been any threat to justify his life being taken...(..possibly quite drunk or something..)...

"On April 4, 2016, a legally armed citizen used deadly force to repel the attacks of Shawn Breland. The Mandeville Police Department concluded that Mr. Breland was the aggressor and that the actions of the lawfully armed patron did not warrant an arrest," said Montgomery.
"Although Mr. Breland’s death is a tragedy, this office agrees that the shooting was legally justified under the circumstances and will not pursue criminal charges based on the evidence submitted to date." ---------- the law hath spoken |

..just because it was judged a legal death doesn't mean that the death had to happen though../that there was no alternative to that being the outcome...the gun was drawn before any physical contact took place and the physical contact at no point appeared 'life threatening' in the vid...

Attack a guy with a gun....get shot.That guy should have backed off as soon as he saw the dude was packing.He basically asked to get shot.

There were at least two of them (shopkeeper and customer) and it was quite clear that the man was not armed in any way. They could easily have restrained him. In my opinion, the little bald chap didn't like being pushed around and made to feel small so he pulled out and used a firearm. Real tough guy.
As Ammi says, the fact that it's been deemed legal where it happened has absolutely no bearing on the morality of it; all sorts of morally dubious **** is "legal". Had he picked up a bottle or started throwing punches then you could argue that he had justification in protecting himself with a gun. This was little more than handbags. Really no need for deadly force ffs. |
