its only 3 months I have all receipts and credit card statement, how isnt this criminal?

Because you can't prove what's in the container and (I would hope!) the storage company wouldn't let anyone into the container but the person who hired it (unless the police have a solid reason to search it, which they don't).

It probably technically is but impossible to prove in terms of pressing charges. She didn't break into your home, and she can simply claim that they were all gifts that you now want back because the relationship ended. Whether or not the police actually believe her story... there's no way to prove it either way. It's her word against yours. Hence a small claims court issue. But the cost of taking it to small claims court will be more than the goods are worth if you don't win the case (you are liable for all court costs if you don't succeed).

Honestly... your best option is to chalk it up to experience and try to be a little more discerning about who you let into your life and your home .
