Would you "want" a legal Middle Eastern immigrant over and above, let's say, a US citizen (we'll say one lacking melanin, for argument's sake) whose Visa has expired but they've chosen to stay anyway?

If not then it has absolutely nowt to do with legality. "Not wanted", certainly.
