Actually he did. She assumed he was a man because he made himself appear to be a man. He changed his body, voice, name, etc. Luke knows when he gets into a relationship with people, he's hiding vital things about himself. It's difficult because most of us don't have to worry about having to reveal our real gender to others; he does.


Even if the law says you can now be a man, it doesn't mean you really are. Biologically, Luke is a woman. Luke has a vagina, not a penis. If Luke stops taking his meds, he'll go back to being a woman. We, as a society, make accommodations for people that's why as much as we know Luke is biologically a woman, we refer to Luke as him, not her.


As much as he's entitled to live his life in a body that's comfortable for him, let's not forget he has to hide things about himself. Even his employer did not know he was a woman until the series started.
